The Supreme Court has scheduled oral argument in Alliance for Community
Media, et al. v. F.C.C.:

WHO: Petitioners:  Alliance for Community Media, Alliance for Communications
Democracy, People for the American Way, American Civil Liberties Union,
Denver Area Educational Television Consortium  ("Free Speech TV");

Respondents: Federal Communications Commission, New York Citizens Committee
for Responsible Media, Media Access New York, Brooklyn Producers' Group;
David Channon; National Cable Television Association, Inc.

Amici Curiae:  Time-Warner Cable, Inc., Morality in Media, Inc.; Association
of American Publishers, Inc.; American Book-sellers' Association, Magazine
Publishers of America, Motion Picture Association of Amer-ica, Freedom to
Read Foundation, Recording Industry Association of America, and others.

The Supreme Court will rule on the constitution-ality of Section 10 of the
Cable Act of 1992 (Pub.L. No. 102-385), and the FCC's implementing rules.
 The law permits a cable operator to censor programming on public,
educational, and governmental ("PEG") access and "leased access" cable
television channels, if the operator believes such programming to be
"indecent," or contain "obscene material, sexually explicit conduct, or
material soliciting or promoting unlawful conduct." Legal issues involved
include whether cable operators' censorship activities can be imputed to the
government; whether PEG access channels are "public forums" under the First
Amendment; and whether cable operators may exercise editorial discretion over
PEG access and leased access programming.
